These Terms of Service (“Terms”) cover your use of whipjacket.com (the “Site”). The Site is run by Whipjacket Productions (“Whipjacket Productions,” “we,” “us,” or “our”).

1. Accepting These Terms

By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

You must be at least 18 years old to use the Site.

2. Using the Site

Use the Site lawfully. You agree not to:

  • Break any law while using the Site.
  • Try to hack, overload, or disrupt the Site.
  • Use bots or scrapers to copy large amounts of content without our written permission.
  • Send spam, malware, or harmful content through our forms.

We may block anyone who misuses the Site.

3. Blog Content Is for Education Only

Our blog offers free, plain-English lessons on using AI assistants and agents in business. It is for general education only.

It is not legal, financial, tax, accounting, or other professional advice. Talk to a qualified professional before making important decisions.

AI tools change fast. Some lessons may become outdated.

4. AI Tools Disclaimer

Many of our lessons discuss third-party AI tools. Please keep these points in mind:

  • AI tools can make mistakes. They can sound confident and still be wrong.
  • You are responsible for checking any AI output before you rely on it, publish it, or act on it.
  • Do not put sensitive, confidential, or personal information into an AI tool unless you understand and accept its terms and privacy practices.
  • We do not own or control third-party AI tools. Their own terms apply.

5. Intellectual Property

The Site’s content (text, graphics, logos, videos, and design) belongs to us or our licensors. Copyright and trademark laws protect it.

You may share links and quote short parts with credit and a link back. You may not copy, republish, sell, or create derivative works from our content without written permission.

“Whipjacket Productions” and our logos are our marks. Please do not use them without permission.

6. Your Submissions and Contact Forms

When you use our contact form or send us a message, you agree that:

  • The information you give is true and yours to share.
  • You will not send confidential information you need protected. Sending a message does not create a client relationship or a duty of confidentiality.
  • We may use your message to reply to you.
  • If you send ideas or feedback, we may use them freely, with no duty to pay you.

7. Third-Party Links and Embedded Content

The Site may link to or embed content from other sites, such as YouTube. We do not control those sites. We are not responsible for their content, products, or privacy practices. Your use of them is at your own risk and under their terms.

8. Our Services

We offer services that include Profitable IT Design, TechStack Acceleration, Slow-Smooth Marketing, KPIs/Dashboarding/Analytics, In-House Media Production Training, and a Mobile App.

Service descriptions on the Site are general information, not contracts. Paid services are governed by a separate written agreement between you and us. If that agreement conflicts with these Terms, the agreement controls.

Pricing, payment, refunds, and cancellation: as stated in your written agreement.

9. No Warranties

The Site and its content are provided “as is” and “as available.”

To the fullest extent the law allows, we make no warranties of any kind, express or implied. We do not promise the Site will be error-free, secure, or always available. We do not promise any business results.

10. Limitation of Liability

To the fullest extent the law allows, we will not be liable for any indirect, incidental, special, consequential, or punitive damages. This includes lost profits, lost data, or business interruption arising from your use of the Site, its content, or any AI tool.

Our total liability for any claim related to the Site will not exceed the amount you paid us in the 12 months before the claim, or US $100, whichever is greater.

Some places do not allow these limits. In those places, our liability is limited as much as the law permits.

11. Indemnity

You agree to defend and hold us harmless from claims caused by your misuse of the Site or your breach of these Terms.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules.

Any dispute will be handled in the state or federal courts located in Santa Rosa County, Florida. You agree to that venue.

13. Changes to These Terms

We may update these Terms. We will post changes here and update the effective date. Using the Site after changes means you accept them.

14. General

If any part of these Terms is unenforceable, the rest still applies. If we do not enforce a right, we do not give it up.
